Conditions or Reasons:1) The proposed development for 6 flats by reason of its bulk, scale and design would be detrimental to the visual amenities and spatial characteristics of the streetscene, and would constitute an undesirable over intensive use of the site which would have an adverse effect on the amenities of occupiers of adjoining buildings. As such the proposal neither preserves or enhances the character and appearance of the Emsworth Conservation Area. The proposal is therefore contrary to policies UB3 and E16 of the Hampshire County Structure Plan 1996-2011 (Review) and Policies D1 and HE1 of the Havant Borough District-Wide Local Plan 1996-2011.
2) The proposal to provide flats would not relate to the form and character of the nearby residential properties or of the Emsworth Conservation Area. It would also create an undesirable precedent which would make it difficult to refuse further similar applications. As such the proposal neither preserves or enhances the character and appearance of the Emsworth Conservation Area and is therefore contrary to policies UB3 and E16 of the Hampshire County Structure Plan 1996-2011 (Review) and Policies D1 and HE1 of the Havant Borough District-Wide Local Plan 1996-2011.
3) The applicant has not demonstrated that the increased number of vehicular movements generated by the proposal can be accommodated using the existing access without causing undue interference with the safety and convenience of the users of Bath Road. Therefore the proposal is contrary to Policy T5 of the Hampshire County Structure Plan 1996-2011 (Review) and Policies T7 and D1 of the Havant Borough District-Wide Local Plan 1996-2011.
4) The application site is located in an area of flood risk. A comprehensive Flood Risk Assessment has not been submitted with the application and as a result, it is not clear how or whether flood risk issues have been addressed. Therefore, the proposal is contrary to policy E2 of the Hampshire County Structure Plan 1996-2011 (Review) and Policy F1 of the Havant Borough District-Wide Local Plan 1996-2011.
5) It has not been demonstrated through an Arboricultural Implications Assessment (AIA), Arboricultural Method Statement (AMS) and Tree Protection Plan that the proposed development would not have a detrimental effect on the health, appearance and longevity of the trees covered by TPO 1884. Therefore the proposal is contrary to Policy UB3, E6 and E7 of the Hampshire County Structure Plan 1996-2011 (Review) and Policies L1 and L6 of the Havant Borough District-Wide Local Plan 1996-2011.
6) The proposal, without completion of the appropriate binding arrangements, is contrary to the Council's approved Green Transport Infrastructure policy, which in accordance with PPG13, seeks to secure an appropriate balance between the individual use of the motor car and a more sustainable transportation system. The development proposed would continue to place unfettered reliance upon the use of the private motor vehicle without contributing to local improvements, which will promote alternative modes of travel. The proposal is, therefore, contrary to Policy T5 of the Hampshire County Structure Plan 1996-2011 (Review) and Policy T11 of the Havant Borough District-Wide Local Plan 1996-2011.
7) The proposal, without completion of the appropriate binding arrangements for four of the units to be age restricted, is contrary to the Local Planning Authority's adopted standards and would, therefore, encourage the parking of vehicles on the public highway, which would interrupt the free flow of traffic detrimental to highway safety. The proposal is therefore contrary to Policy T5 of the Hampshire County Structure Plan 1996-2011 (Review) and Policy T9 of the Havant Borough District-Wide Local Plan 1996-2011.
Informative notes:1) You are advised that the Council may not be minded to enter into a S106 obligation for age restricted occupancy unless there are interests of acknowledged importance which merit such a restriction, and it has been demonstrated to the satisfaction of the Local Planning Authority, that the scheme meets all the needs of an age restricted development.
